The candle and the funeral cost

As a civil-court war is declared on former State board appointees, more resources must be pushed towards cleaning stables and bolting doors than on catching horses. Commissioner Gibbs may be from the rodeo province of Alberta but it will take lots of time on the saddle to land this country's stray-way broncos. Moving backward and forward, the work of the Attorney General (AG) and the Director of Public Prosecutions (DPP) must have two clear and consistent end results: catching the crooks and fixing the problems. Catching the crooks requires that Gibbs and the DPP have lots of resources and are free from political influence. Fixing the problems requires a redesign of the Corporation Sole, a quaint office whose lack of life is central to decades of State Board misbehaviour. Those two end results are on the to-do list but now the AG introduces a third possibility: restoring some money to the taxpayers.

On that prospect of recovering some money, let us be realistic about what the AG has set in motion in civil action against former boards. Without seeing the documents filed, I refer loosely to action taken by the AG, both on behalf of and with the sanction of the aggrieved State company or on behalf of the Corporation Sole, the aggrieved shareholder. Either way, the action traces back to the State. There are views on the extent to which this civil action oversteps the separation of powers, in answer to which I say it is on account of the separation of powers and not in defiance of it, that the AG has gone the route of civil action, his office having no direct control over the office of the DPP. The two types of action are quite capable of running in parallel, the underlying law and objectives being different. It is also a course contemplated by the Constitution, permitting the AG to commence the legal action he has. The lawsuits are unprecedented but within the AG's authority, ceteris paribus. But what will it cost and what do we get for the money?

Previous columns addressed the unknown costs and timelines of various investigations initiated by the Government. They also called for greater transparency in the appointment of legal counsel in these corruption investigations, even though such selection relies heavily on the AG's assessment. Still, I believe the public will support any action to retrieve taxpayers' money, subject to that being the genuine purpose of the action and given a chance that the candle will not cost more than the funeral.
