Police: Sailboat too crowded in fatal Calif mishap
Too many people were on board a sailboat that capsized and killed two passengers for a ride on San Diego Bay for people with special needs, police said Wednesday.The port of San Diego Police found that the overload condition of the ship and the absence of life jackets have contributed to the March 27 mishap.
According to investigators, the sail was organized jointly with tape or staples, and the ship was to be expected wear and tear of a ship made in 1988.
When it capsized, there were 10 persons on board the boat 26 feet, which is designed to accommodate six people, said Port Police Chief John Bolduc.Investigators also found that the weight on board was unevenly distributed.
San Diego County prosecutors reviewed the results and do not anticipate criminal charges.
"We just do not" feel that we have sufficient evidence to support a charge of criminal negligence, "said Bolduc." We can not recreate exactly what happened that night, but we believe that there are certain factors that contribute, but certainly none that reached the level of criminal charges. "
The police had strong words for the heart of Sailing Foundation founder George Saidah, who was driving the boat and often took passengers on routes to Bloomington, Ind.Based on charity.

John Shean, a lawyer and chairman of the board of Heart of Sailing, said he had not seen the police report and could not comment on its findings.
"They spent four months looking at this" Shean said."I'm sure they did a thorough job."
In March, Shean said a gust of wind caused the boat to tip. He said Wednesday he still believed it was a factor. However, Bolduc said investigators found no evidence that weather conditions have contributed to the accident.
Chen Chao, 73, and his son, Chen Jun, 48, of San Diego, drowned. They were the grandfather and uncle of a boy of 11, with autism on the boat. Bolduc said that neither adult was wearing a life jacket, if there were "many" available on board.
The other eight on board, including an adult with special needs, was dumped in water at 55 degrees.

Can one cross the Atlantic ocean on a Macgregor 26 sailboat?
If so, what would be the best route to take so to reduce the longest continues stretch of open water? Is that the best strategy? How long will it take? Is going West to East, East to West requires different routes? When is the best time to do it? Is a boat of that type likely to sink/break from the sea forces alone or only by striking a solid object? Is it conceivable to evade developing bad weather by simply motoring/sailing away in another direction? Can one weather out a storm by lowering sails and tying down everything on deck, then taking a snooze until its over, assuming you are in the middle of the ocean and aren't likely to strike anything? What would be the most affordable sailboat that you would recommend for such a journey if this one isn't ideal? I've read somewhere that smaller boats are actually stronger than larger boats and that the larger boat mentality is propagated by the boating industry to make more money, is that true? Any other information would be appreciated.
